Davis was convicted of third-degree criminal sexual conduct (sexual penetration of another whom the actor knows or has reason to know is mentally incapacitated or defective) in the Washtenaw Circuit Court, Patrick J. Conlin, J. Defendant appeals. Held : 1. The crime requires proof only of the general intent to commit sexual penetration. Intoxication preventing the defendant from knowing that the other person is mentally defective where a reasonable person would have known is not a defense.
