Pfeifer and wife determined upon a distribution of their land to their eight children. Defendant, a son, received a deed to 80 acres but was to pay $500 each to his brother Emil Pfeifer and to his sisters, Mary Sheridan, Mollie Timmins and Amelia Fisher. He paid $500 for Emil and gave to his parents a note for $1,500 to evidence the indebtedness to be paid to his three sisters. Amelia Fisher, with the acquiescence of her parents, assigned her $500 interest to her sister, the plaintiff. Thereafter defendant renewed the note in form payable to his parents, and still later and after the death of the father he made a renewal note to the mother, who has since died. In this action to recover the Amelia Fisher $500 and interest it is held:
