Journeymen Pipe Fitters Local 392 (hereinafter Union or Local 392) petitions this Court to vacate and set aside an order of the National Labor Relations Board (the Board) finding that the Union violated §§ 8(b)(1)(A)*fn1 and (b)(2)*fn2 of the National Labor Relations Act (the Act) by breaching its duty of fair representation in the operation of its exclusive hiring hall. The Board has cross-petitioned for enforcement of its order. For the reasons stated below, we deny enforcement of the Board's order.
